Title 13, section 1319-S of the Maine Revised Statutes sets forth procedures for closing a hazardous waste facility in the state of Maine. Pursuant to this section the Maine Board of Environmental Protection (MBEP) may require the present or subsequent owner of the land used for a hazardous facility to execute and record a restrictive covenant on the present and future uses of all or part of the land. The section provides that the MBEP can require execution of a restrictive covenant only when necessary to protect human health and safety. Covenants executed under section 1319-S run with the land and must be recorded in the registry of deeds of the county in which the facility is located. The section includes procedures for modification or removal of restrictions.
