This template contains model language for proper implementation of deed notices and deed restrictions at properties remediated pursuant to Pennsylvania’s risk and exposure based remediation standards. The template for deed notices requires identification of the standard or standards under which the property was remediated and a description of the hazardous materials disposed on the property. The notice section also requires specification of which materials remain above residential statewide health standards. The template for deed restrictions requires a description of the remedial activities, restrictions on the land use, and required or prohibited activities. The template for deed restrictions also includes language on breach or removal of protective measures, how excavated materials are to be removed, and stipulates that the covenant and its restrictions and requirements run with the land.
