On June 13, 2005, Nevada Governor Kenny Guinn signed into law SB 263, an Act Adopting the Uniform Environmental Covenants Act (UECA). UECA establishes a process for creating, modifying and enforcing environmental covenants. Environmental covenants created under UECA will not be subject to common law rules, which have prevented land use restrictions from enduring over time. UECA requires environmental covenants to be recorded in the local land records and thereby bind successive owners of the property.
